Pelican Prosecution Changing Attorneys' PI-Hiring Habits?
We've more or less ignored the Anthony Pellicano case here at
The Daily Caveat. Frankly, I can't much relate to the kind of "investigative" work he practiced. As salacious and juicy as the case proved to be, it never felt right to cover Pellicano's prosecution in this space.
However, an interesting offshoot of the case (in which
attorneys who employed Pellicanos found themselves under indictment) is a "wake up call" for attorneys on how they use the services of private investigators.
Law.com has thoughts from several notable attorneys on the ripple effects from the case. Here's a hint - you want the one who is willing to tell you "NO" and makes it their business to keep you away from garbage tactics that can embarrass your client or sink your firm. Anything that sounds too good to be true probably is.

Hedge Fund Dirty Tricks and the HBOS Implosion
You'll love
this article from The Daily Telegraph - an inside look at the "dirty-tricks unit" of a London-based hedge fund. This story has all the good stuff - PIs, hacking, the obligatory sub-prime mortgage crisis connection, rogue traders, market manipulation - it's
one stop shopping.

Witness Location of a Somewhat Different Sort
I've seen the jungle in Singapore, first hand.
It pretty much looks like lots and lots of this:

Also, there are lots of monkeys exactly like this one who was completely un-intimidated by us and also quite adamant that we give him something tasty before entering his jungle:

So I have great sympathy for the life and work of a Singapore-based Private Investigator who makes his living tracking down foreign worker runaways across the border in Malaysian.

Ohio Bureau of Workers’ Compensation Worker Pinched For Selling Personal Data to Private Investigator

Welcome to 2008
Hope everyone found their way through the holiday season unscathed.
The Daily Caveat is back in action starting today.
I've got a pile of articles to go through from the last week and several submission from readers (
many thanks!) to review.
For starters, let me invite you to check out this report that embattled Yankees Pitcher,
Roger Clemens has hired private investigators to aid in disputing recent allegations that he used performance enhancing drugs.
The steroid charges stem from testimony provided in connection with the recent
Mitchell Report, which sought to did deep into the potential use and abuse of steroids and other drugs amongst major leaguers.
Can't say I have much faith in Clemens' protestations. In any case he's been dead to me since he left the Red Sox.

FTC Settles With Pretexting Phone Record Thieves
Wired has the full details, including a breakdown of the defendants and associated judgments. Kind of a wimpy showing from the Feds if they expect to deter this type of conduct. NetworkWorld
supplies the incredulity.-- MDT

Wired Magazine Covers the PI Pretexting Embroglio
Investigators from Washington, California, Oregon, Texas and New York are all involved in this pretexting mess:
Emilio Torrella, BNT Investigations, Washington State
Brandy Torella, BNT Investigations, Washington State
Steve Berwick, BNT Investigations, Washington State
Victoria Tade, C.I., Inc., California
Megan Ososke, P.I. and Information Services, Oregon
Robert Grieve, Robert Greive International, Texas
Ziad Sakhleh, Robert Greive International, Texas
Darci Templeton, sole proprietor, Texas
Patrick Bombino, AAA Allstate Investigations, New York
Esau Pinto, AAA Allstate Investigations, New York
Primaries and subcontractors are both represented here... It seems pretty clear that in the wake of the HP publicity one step removed isn't going to be a helpful buffer when it comes to pretexting / ID theft-related allegations.
And that's a good thing. This kind of conduct is an insult to the investigative process - whereby legitimately obtained public records and source interviews produce actionable information on behalf of clients.
Check out the
comments from Wired's information security blog right here and don't miss
the link to the full indictment, (filed in the Western District of Washington State) which should make for interesting reading.

UK "Investigative Firm" in Hot Water
A UK based investigative firm is trouble for failing to perform contracted services. According to
this press release, Advance AIT Limited and is under investigation by the Companies Investigation Branch of the
Insolvency Service. According to the CIB investigation:
"...Advance AIT relied on misleading promotional material and a false reference from a customer stating that it had recovered the sum of £9,000 for that customer. Advance AIT continued to trade despite being insolvent, to the detriment of customers and other creditors and owed £323,146 to its creditors. During the winding up proceedings the court heard that Advance AIT Limited conducted business in way that was inherently objectionable and detrimental to members of the public."

Ice Cream King Tom Carvel Was Murdered?
So claims his niece, Pamela Carvel. Although the man who brought us
CookiePuss and Fudgy the Whale is 17 years gone, and assumedly died from natural causes, Pam Carvel is convinced foul play was involved.
This week Pamela filed a formal request in Florida to have her uncle's body exhumed for examination. She claims that many members of the Carvel family have long suspected that Tom was drugged and murdered after he discovering that key employees were stealing from his company.
We must not rest until Tom Carvel has justice...I think that goes without saying. But not everyone in the Carvel family feels Pamela's actions are of pure motive...
More on the Carvel family drama, here.
